Children and Parenting Issues
If you have children and you are going through a New Jersey (NJ) divorce or family law matter, there are a number of issues and concerns that will need to be addressed.
Child Custody, Parenting and Visitation
The three different child custody arrangements that are applied on a case by case basis are: joint, shared and sole custody. The right arrangement for you and your family may not be right for someone else because all family law matters are unique. Our New Jersey child custody lawyers will help you resolve even the most complex child custody matter.
Child Support and Child Support Guidelines
New Jersey child support is generally calculated using the New Jersey child support guidelines. These guidelines help determine how much money the state of New Jersey sets for each parent to contribute for child related expenses. If both parents have a combined net income of $150,800 then the child support guidelines will generate the accurate amount of the child support obligation. If, however, both parents have a combined net income greater than $150,800 the NJ child support guidelines will still apply but with additional support added on top of the child support amount calculated from the guidelines.
Paternity
When determination of parenthood/fatherhood is in question (paternity), you should know that there are mechanisms to establish your rights and obligations.
Adoption
When you are looking to expand your family unit, there are various types of adoptions available to you. Adoption applies to both individuals and couples looking to bring a child into their home or an existing step-parent, relative or grandparent seeking child custody rights.
Father’s Rights
A man going through a divorce or dealing with child custody and/or child support issues has the same legal rights as a woman. These father's rights can be protected.
Mediation
If you and your spouse are willing to resolve your matter in a non-litigious manner or you believe that you are close to reaching an agreement on child custody, visitation and/or other child related issues, you should strongly consider finalizing the details of your agreement with one of our family law mediators. Our mediators will guide the both of you through an amicable way of dealing with your children and parenting issues in a more cost effective and more stress free manner than a traditional litigated case.
