Mediation is a process by which both parties sit down in good faith with a neutral professional, the mediator, with or without your lawyers present. This process affords you the opportunity to actively participate in your own negotiations with the expertise and guidance of your lawyer either at the session with you or in a strategy meeting prior to the session. The mediator does not make any decisions but may make suggestions during your confidential sessions. Nothing discussed in a mediation session is formally recognized as enforceable as an agreement unless there is a formal consent ordered Agreement which is signed by both parties. In other words, mediation is non-binding.

However, in the event that the sessions do not result in a favorable outcome or agreement, both parties are free to terminate the mediation sessions without the threat that anything discussed in mediation will be used against you in the courts.
