New Jersey (NJ) Private Mediation Attorneys
When both parties are willing participants, the parties may elect to attend private mediation with one of our mediators, with or without their attorneys present. In these mediation sessions we will attempt to resolve your family law related matters. Whether it is creating a property settlement agreement, creating child custody, child visitation and parenting plan agreement and/or attempting to resolve all of your economic matters, we are committed to this form of alternative dispute resolution. If you attend a private mediation without an attorney, you can take comfort in knowing that you have our professional mediator in the room that is not only skilled at maintaining control but also educated in family and matrimonial law. It is imperative that when you are looking to mediate a matter as important as custody, parenting time, visitation and your financial issues, that you have a mediator who is knowledgeable of all of the statutory and case law in this field of law. Our mediators have extensive experience in this field since our practice is devoted exclusively to family and family law matters.
When Private Mediation Can Take Place
Private mediation can take place before any action has been filed in the courts. For instance, you may elect to attempt to reach a settlement through mediation before you file a child support modification request with the court and ask a judge for a decision on the issue. This allows you and the other party to maintain control of your final outcome. However, private mediation may also take place while the court action is in the process. The courts tend to be proponents of the mediation process because if your matter settles it is ultimately one less matter for the courts to deal with.
Who Makes Payment For Private Mediation?
Private mediation is paid for at each session by the parties, whether through joint assets and accounts or by other means, depending upon what was agreed to in advance.
Your Independent Lawyer Cannot Also Serve As Your Mediator.
One of our family and matrimonial lawyers can attend a private mediation with you as your attorney or one of our family and matrimonial mediators can serve as a private mediator to help resolve your family law matter outside of the courts. You must note that if an attorney at the Weinberger Law Group serves as your mediator (a neutral role), a lawyer from our firm cannot thereafter serve as your attorney (an independent advocate role).
