A will is a (written) legal document that determines how your property, known as your estate, will be distributed after your death. Your estate is comprised of assets and property including all financial assets, real estate, automobiles and furniture. In general, you can dispose of your property any way you would like based on New Jersey law. For those people with children, a will can be used to designate who will be the guardians of the minor children in the event that both parents died before the children reached the age of majority. Many people are under the incorrect belief that only people with significant wealth should have a will; however, this is completely untrue. If no will is in place at the time of death, all of the decisions regarding the assets and the children are left solely up to the court’s discretion, as per New Jersey law.
