New Jersey (NJ) Durable Power of Attorney Lawyers
A durable power of attorney is a written legal document that enables you to allow another person to make financial and legal decisions on your behalf. This power is called durable because it will remain in effect even if you become disabled or incapacitated. If a power of attorney is not specifically designated as being durable, then the power ends if the person granting it becomes incapacitated. Some people prefer for this power to only become effective should they become mentally incompetent as certified by a physician or other designated individual. This type of durable power of attorney is called a springing durable power of attorney because it is said to “spring” into effect at such time as you become mentally incompetent. In either case, a durable power of attorney expires upon the death of the person who granted the power.
