EMANCIPATION OF A CHILDNew Jersey (NJ) Emancipation LawyersA child may become emancipated (legally an adult) upon reaching age 18, if the child marries or "moves beyond the sphere of influence" of the parents. However, emancipation is not typically automatic. The standard for emancipation is oftentimes expanded in a number of circumstances, especially when a child continues on for post-high school education, since the child is recognized to still need financial support from his or her parents. Before you stop making court-ordered payments, seek the guidance of our knowledgeable custody and child support lawyer about your case. Failure to pay child support can result in significant penalties and possibly even jail time. Also, if you receive support on behalf of your child, you should not necessarily accept termination of payments because your child turned 18 and you believe that it is reasonable for child support to end. This is a common misconception. In actuality, the right to receive support is the child’s right- not the parent’s right. You should meet with one of the New Jersey child custody and support lawyers at Weinberger Law Group, LLC to help you with all aspects of your child custody, child support and enforcement needs.
